These Terms of Service ("Terms") are a legal agreement between you and Emerson Cesa, doing business as ECHA ("ECHA," "Company," "we," "us," or "our"), a California sole proprietorship and licensed HVAC contractor that operates the ECHA HVAC Sacramento website at echahvacsacramento.com (the "Site"). By accessing the Site, submitting a request, or using our services, you agree to these Terms. If you do not agree, please do not use the Site.
Please note: ECHA is a licensed HVAC contractor that performs the services described on this Site directly with our own technicians. Any prices or estimates shown are for general planning only - only a written quote for your specific job is binding. See Sections 2 through 4.
1. Acceptance of These Terms
You must be at least 18 years old and able to enter a binding contract to use the Site. By using the Site you represent that you meet these requirements and that the information you provide is accurate.
2. What We Do
ECHA is an owner-operated, licensed HVAC contractor serving Antelope, Sacramento, and the surrounding area. We provide residential and commercial HVAC services - including air conditioning, heating, installation, repair, and maintenance - directly to our customers with our own trained technicians. When you request service through the Site, you are contacting ECHA directly.
3. Our Work & Workmanship
We perform all work ourselves and stand behind our workmanship. If you have a concern about work we performed, please contact us and we will make it right consistent with any applicable warranty and California law.
You agree to provide safe access to the equipment and accurate information about your property and system so we can complete the work safely and correctly. Scheduling windows are estimates and may be affected by weather, parts availability, and emergencies.
4. Estimates and Pricing
Any prices, ranges, or estimates shown on the Site or discussed by phone are for general planning only and are not binding. Only a written quote provided to you for a specific job is binding.
5. Your Responsibilities
You agree to provide accurate information, to use the Site lawfully, and not to misuse, disrupt, or attempt to gain unauthorized access to the Site or its systems.
6. Consent to Be Contacted
By submitting your information, you consent to be contacted by ECHA by phone and email about your request, as described in our Privacy Policy. Text messages are sent only if you separately check the SMS consent box on one of our forms, as described below. Consent is not a condition of purchase.
Program name and description
The ECHA messaging program sends transactional text messages: replies to your inquiry, appointment confirmations and reminders, technician arrival updates, and follow-up about service you requested.
How to join
You join by checking the SMS consent box on a form on this website, or by giving us your mobile number and agreeing verbally. The box is unchecked by default. Consent to receive text messages is not a condition of purchasing any goods or services. You must be 18 or older and the owner or authorized user of the phone number you provide.
Message frequency and rates
Message frequency varies with your service activity; we do not guarantee a set number of messages. Message and data rates may apply to messages we send you and messages you send us. For questions about your text or data plan, contact your wireless provider.
How to opt out
Reply STOP to any message at any time. We will send one confirmation, and you will receive no further messages from the program.
How to rejoin
To start receiving messages again, opt in the same way you did originally by checking the consent box on a form on this website.

Carrier liability
Wireless carriers are not liable for delayed or undelivered messages. Delivery depends on network availability and other factors outside our control.

Compliance
This messaging program is operated in accordance with CTIA Messaging Principles and Best Practices, the Telephone Consumer Protection Act (TCPA), and applicable wireless carrier requirements for A2P messaging.
7. Intellectual Property
The Site and its content - including text, graphics, logos, and design - are owned by or licensed to the Company and are protected by law. You may not copy, reproduce, or reuse them without our written permission.
8. Disclaimers; No Warranty

We do not warrant that the Site will be uninterrupted, error-free, or secure. This does not limit any warranty we provide on HVAC work we perform.
9. Limitation of Liability
To the fullest extent permitted by law, the Company and its owners, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site. Our total liability for any claim relating to the Site will not exceed the amount you paid us, if any, for the specific service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under California law.
10. Indemnification
You agree to indemnify and hold harmless the Company and its owners, officers, and employees from any claims, damages, or expenses arising out of your misuse of the Site or your violation of these Terms.
11. Governing Law & Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree to first try to resolve any dispute with us informally by contacting us. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Sacramento County, California.
12. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted, and the "Last updated" date will be revised. Your continued use of the Site means you accept the updated Terms.
